  Relocation Advice - What You Should Know

Old Apartment

Old Lease
Terminate your lease in line with the period of notice; otherwise you may have to pay double rent. You must terminate your lease in writing, as oral terminations have no legal force. Periods of notice range from 3 to 12 months, depending on how long you have lived in the apartment. If you have a temporary lease, you are only permitted to move out prematurely if the lease includes a clause on finding a substitute tenant. You can, however, also arrange with the landlord that you will find a new tenant. You can only do this in exceptional cases.

Bond
If you paid a bond when you moved into the apartment, you should arrange with your landlord to have the money returned. The landlord must return the bond with any interest accrued. If the landlord has been paid in full and their expenses are already known, they must repay the bond immediately. In other cases the landlord has a period of deliberation that may, under certain circumstances, last for over 6 months.

Renovations Discuss all necessary renovation works that you must complete before you move out with your landlord. Request that the landlord records the renovations that you have made in the handover report made when you move out. This can save you a lot of hassle.

Cosmetic repairs are only the tenant's responsibility when this is expressly stipulated in the lease. Clauses in the lease that claim that the tenant has to renovate the apartment both upon moving in and upon moving out are invalid.

Cosmetic repairs generally only include painting and decorating. Replacing a carpet, for example, is only the responsibility of the tenant in cases of excessive use or damages caused by the tenant.

Selling Items / Passing Items On
Speak to your landlord or next tenant about selling fixed objects such as a built-in kitchen, built-in cupboards, curtain rails, carpets, antennae, indirect lighting etc. They may purchase the objects for a certain fee.

Time Off For Moving House
Apply for time off in good time.. Ask your employer whether you are entitled to special holiday for the relocation.

Bulky Waste / Disposing of Waste
Enquire at your local authorities for the next collection date. Empty out the loft, cellar and garage. You are sure to find a large number of items that you will not want to take with you to your new home. Getting rid of items saves on transport costs!

Tradesman
If you require a tradesman to fit a washing machine, oven, built-in cupboards or a built-in kitchen then consult your AMÖ forwarder in good time.

New Apartment

New Lease
Read your lease through carefully before you sign it. Pay special attention to the clauses that deal with money: e.g. agreements concerning cosmetic repairs, maintenance, bond and extra costs. Take care when it comes to graduated rents! In the case of a temporary lease, see if there is a clause concerning finding a replacement tenant. Be aware of so-called fixed leases with the clause that the landlord will use or rebuild the apartment once the lease has ended. After this period you will no longer have a protected lease.

Bond
A bond does not always have to be paid at the beginning of a tenancy. The prerequisite is an agreement between the tenant and the landlord about a security deposit. The bond is there to give the landlord some security, in case the tenant does not fulfil their contractual obligations. The bond must not be more than three months' rent (not including heating bills), and the tenant can pay it in up to three installments. The bond must be paid into a special account (savings account) and interest should be collected on it. Ask your tenant association for the safest type of investment. The tenant and landlord can also agree to put the security deposit in a bank guarantee.

Renovations
Get the condition of your new apartment in writing prior to moving in. If in doubt, take photographs.

Purchasing / Taking Over Items
Speak to your landlord or previous tenant about purchasing built-in kitchens, built-in cupboards, curtain rails, carpets, antennae, indirect lighting, etc. You may be able to take these items over for a certain fee.

Agency Fees
If you have acquired your new apartment through an agency, they may only demand a fee if their help has resulted in a lease. If they are the owner, an administrator or a landlord of the apartment, or if it is social housing, there can be no brokerage fee. The law stipulates that the brokerage fee must not exceed 2 months' rent incl. VAT.
